High Speed Chases Causing Car Accident and Personal Injury

Sometimes I wonder why, in this day and age, we have police officers chasing folks in hazardous high-speed chases, causing death and injury to those particular individuals who are unlucky enough to be in their way?Officer Beall of Blatimore, Maryland was one such police officer who in his case allegedly caused the death of a motorcyclist during such a chase after he had apparently been told to halt it, and he was suspended. I do not think you can blame the whole department for that since it appears to be caused by the actions of a single officer, and no force has all perfect members, we know that. I suppose this is just one reason why the Baltimore injury attorney firms and car accident law firsm in Maryland seem to stay fairly busy overall.
It was reported on the online news site, wbaltv.com, that Holloway-Lilliston had a valid Maryland driver’s license, but he did not have a motorcycle license. In a piece under the headline, “Officer, City Sued Over Fatal Motorcycle Crash,” posted April 6, 2011, it was noted that the motorcycle Holloway-Lilliston was driving displayed tags listed to another motorcycle, but the motorcycle was not reported stolen.
The story was previously reported on the same news site, under the headline, “Officer Suspended After Fatal Crash With Motorcycle,” posted July 26, 2010. That piece reported that Maryland State Police at the Golden Ring Barracks were notified that a city officer was tracking a motorcycle that was speeding north on Interstate 83. In Los Angeles of course, much like Baltimore but even more so, this is a big issue, and the Los Angeles accident attorney
and personal injury firms seem to do well as a result of all the car accident cases.
Officer Beall called the barracks and reported that he was following a motorcycle he believed was stolen; “Soon afterward, state police learned of a traffic crash on the ramp to southbound Dulaney Valley Road from the Inner Loop of Interstate 695.”
More details will surely come out in this case, but it won’t be the last time a police pursuit is involved in a death or injury.

Determining Liabilities In Nursing Home Abuse Cases

When nursing home abuse or neglect occurs there are factors that are used to determine the liability, beside medical malpractice, which is the most often, thought of when liability is questioned. There are other types of liability, including premises liability and inadequate security. Premises liability occurs when a nursing home violates its legal duty to provide quality care to the resident of the nursing home.

It is the nursing homes responsibility to inspect the premises an properly attend to any dangerous conditions and if an injury occurs due to dangerous conditions that have not been corrected the nursing home is liable. The inadequate security can be inattention or understaffing, which the nursing home can be held liable.  If there is a medical error by the facilities doctor, nurse or other staff member in providing care to a nursing home resident, this can be interoperated as medical malpractice.

Exemplary Damages

Exemplary damages in nursing home abuse, which are a way to punish the damaging conduct and to inhibit future misconduct. These are damages that are above what is awarded based on malice, or fraud in gross neglect or wrongful death cases. When the plaintiff is injured, it can be considered malice if there was a specific intent by the defendant to cause the injury. In nursing home settings, when the defendant is aware of the risk for potential harm, no matter the degree of the potential harm and still proceeds with lack of concern of the welfare, safety or rights of others this is cause for exemplary damage claims.

Gross neglect in wrongful death cases is defined in the same way. Caring for the elderly in nursing homes and acting with misconduct by administering the wrong medication, providing professional care while impaired, mistreatment of the elderly or providing the wrong medical treatment and knowing this is not an acceptable course of action is also a foundation for an exemplary damages lawsuit.

Experienced nursing home lawyers specialize in protecting the rights of the nursing home neglect victim. If you or a loved one has been a victim of nursing home abuse and neglect consulting with an attorney that specializes in this area of the law will be able to determine whether or not there is a basis for an exemplary damages lawsuit.

Prolotherapy or Tommy John Surgery?

Prolotherapy or Tommy John Surgery?

For many years we have seen parents in our sports medicine clinic who have inquired about “Tommy John” surgery for their school age baseball player – especially the pitchers. Sometimes they are disappointed when we tell them that the surgery is not necessary. Disappointed? Yes, because they think the surgery will make their child a better pitcher in the long run.

In a study presented at a 2011 meeting of the American Orthopaedic Society for Sports Medicine. Researchers admitted alarm when surveying parents, coaches, and players about Tommy John surgery. What alarmed them was that a large portion of the survey group (including 51% of High School age players) believed that even if there was no elbow injury, the surgery will be warranted if a pitcher could through faster and with more control.

There was also a misconception in the recovery time. Many surveyed believed that recovery time needed for Tommy John surgery was nine months, when in fact recovery time would be over a year for a baseball pitcher.

Obviously, if it is not making you a better pitcher, and the recovery time takes you past “next season.” Options need to be looked into.

What is Tommy John surgery?

Tommy John surgery replaces the Ulnar collateral ligament of the elbow with a tendon from elsewhere in the body. It is procedure typically reserved for baseball players, especially pitchers, and javelin throwers, where a completer tear or rupture has occurred. It is named for then Los Angeles Dodger pitcher Tommy John who had the procedure performed in 1974.

Beliefs Debunked

The belief that a pitcher will throw faster and with more control has been debunked. The inventor of the procedure Frank Jobe MD, and other surgeons say that two main reasons a pitcher may throw with more velocity is that UCL injury occurs because of the degeneration process. Over the course of time velocity is lost as the ligament breaks down. When the ligament is replaced, original, not enhanced, velocity is restored. Secondly, after surgery and during the lengthy rehabilitation process, the pitcher becomes more attune to physical conditioning and proper training techniques.

Prolotherapy not Tommy John Surgery

In our Sports Medicine clinic in Los Angeles we see many High School athletes with damage to the UCL. If the ligament is not completely torn, Prolotherapy can affect the same positive results as Tommy John surgery without the one year layoff or surgical complications.

Here is how it works:

During the degeneration process, the UCL becomes weakened, frayed and laxed. This puts the ligament at high risk for complete rupture. Here is where Prolotherapy can be a very successful treatment helping to prevent a complete rupture and keep the pitcher pain-free. Prolotherapy is an injection technique that utilizes the positive side of inflammation to stimulate the rebuilding of the ligament through the natural healing process.

When a Prolotherapy injection is given, the main ingredient dextrose (a simple sugar), causes a controlled inflammation. Inflammation, being the body’s main healing mechanism, brings the immune cells necessary to rebuild and strengthen the ligament. As opposed to surgery, UCL repair can be achieved in a matter of weeks. In addition, unlike Tommy John surgery the original ligament can show, according to numerous research studies, a 200 – 400% increase in strength and tissue thickness.

Elderly Abuse and Neglect

The estimate by a Senate Special Committee on aging is that every year there are as many as five million abuse victims that are elderly Americans. The number is even higher, since many incidences of elder abuse goes unreported and with baby boomers joining the ranks of senior citizen the number of elderly abuse and neglect statistics is expected to increase.

There are specifics that the National Center on Elder Abuse is defined:

  • Physical abuse
  • Neglect
  • Abandonment
  • Emotional abuse
  • Sexual abuse
  • Exploitation

The signs of abuse and neglect are not always obvious and then there are some types of abuse that is more obvious, the most common form of elder abuse in nursing homes is neglect. The signs of physical trauma of the elderly nursing home patient should be monitored, questioned, reported and investigated. The less evident signs of abuse will require close attention to changes in mood or can even manifest as a debilitating form of depression, which can occur due to verbal abuse, rather than physical elder abuse that results in bruises, and the need for a wrongful death attorney.

Elderly nursing home patients have gone there to be cared for when they can no longer care for themselves and this also makes them vulnerable. The elderly patient is frail and even the slightest change should not be ignored in their physical appearance or mental state and should be questioned.

Unfortunately the elderly nursing home patient is at risk to be a victim of nursing home abuse, by the people that have been entrusted to care for them. This puts family, friends and other visitors in the role of protector for the elderly person that can be the victim of elder abuse or neglect by the people that should be providing care. When there is any suspicion of nursing home abuse or neglect questions should be asked, information requested, discussions of the suspected nursing home abuse and contact an experienced elder nursing home abuse attorney.

The nursing home abuse attorneys have the experience necessary to hold nursing homes accountable for the abuse that has taken place at the hands of their nursing staff. Contact one for a free consultation when a elderly nursing home patient has become a victim of abuse.

Differences Between Direct and Indirect Negligence

Nursing home negligence is a continuing problem in nursing homes across the United States, this is proven in the annual federal and state nursing home inspections, according to government findings. There are many forms of negligence the elderly nursing home victim can be subjected too, which can be either direct or indirect. The direct nursing home negligence and indirect negligence can be seen in the emotional or mental changes in the elderly resident, information the nursing home patient might relay, poor hygiene and housekeeping conditions and there can be difficulty with communication with the nursing home staff.

Nursing home patients may be afraid to communicate the nursing negligence that is occurring due to intimidation and fear, or when they cannot communicate. This is when family, friends and visitors must be extremely alert in order to protect the nursing home resident.  When you suspect that direct or indirect nursing home negligence is occurring it is important to have an experienced nursing home abuse attorney to protect the elderly patient. The nursing home abuse attorneys are committed to protecting the elderly nursing home negligence victim.

Bruises

Nursing home patients are more at risk for falling and this can lead to bruises, because of their thinner and more delicate skin. Medications the elderly person is taking could also cause easier bruising. Bruises can also be a sign of nursing home physical abuse. This is why family, friends and other visitors of the nursing home patient need to make note of bruising. Then it can be possible to determine if they appear with frequency, if there is a pattern with the occurrence of the bruises, along with anything else that might seem unusual.

Bruising can be a sign of nursing home abuse, especially when there are other signs present including the change in the person’s demeanor, anxiety, becoming frightened easily, unusual quietness and other physical signs. Question your loved one about the bruises and ask to see the nursing home staff reports, which should match what your loved one has stated about their bruising.  Ask the nursing home staff to provide this information, be alert to their reaction and if they are willing to help provide the information or seem reluctant to address your concerns about injuries. The most important thing that should be done is to document the bruising injuries and the nursing home staff’s willingness to discuss the injuries.
When there is a suspicion that a loved one has suffered nursing home physical abuse, then a nursing home abuse attorney will be able to help stop the abuse. They are able to use their experience to ask the proper questions and to take legal action when necessary to hold the nursing home negligent parties accountable.

Emergency Rooms just for Seniors

I just returned from a nice trip to maui to check on some real estate, time to blog…According to the Associated Press, some hospitals are opening ER’s just for elderly patients. Now the seniors can receive much needed medical attention in more quiet and less crowded rooms. This new trend is expected to grow as the population rapidly ages. Elderly patients account for 17 million ER visits a year. However, most emergency rooms are equipped to deal with the victims of car accidents and shootings, not with the lengthy process of diagnosing elderly patients’ problems. I read about this on the Medical News Blog
For their part, Doctors who specialize in geriatric medicine believe that older people may not have the same needs and illnesses as younger and middle-age patients. This is a big issue in Phoenix, for example. A new research shows that ER’s don’t routinely check for dementia and depression that are common problems for seniors. Sometimes people with such medical conditions have trouble describing their symptoms or understanding their treatment. For those patients Senior Emergency Center began follow-up calls to monitor their condition at home. I have noticed that many Sun City nursing homes have various levels of elderly care options such as assisted living, Alzheimers care, and the like. And I see this in senior communities as well, not just in nursing homes and their alternatives. I had noticed that Maui was becoming a popular place for them as well, what with all the golf courses, etc, despite the high real esttae over there. By the way, this Maui real estate
site can help if you are looking to locate some Maui real estate. About ten emergency rooms just for seniors have opened in the US since 2008, most of them are operated by Trinity Health Novi’s senior ER program. Catholic health system provides much needed nurturing environment with low noise levels and caring medical personnel. Rooms have nonskid floors and comfortable reclining chairs. Doctors and nurses are specially trained to uncover underlying problems in seniors’ lives that bring them back to the hospital. Senior centers are committed to improving care for elderly people and they are truly appreciated by their patients.
