			<content:encoded><![CDATA[<p>February 15, 2012-According to reports the driver that struck a woman and her two children Tuesday is listed in critical condition after hitting a tree.  According to Fullerton Police Sgt. Andrew Goodrich the accident occurred at approximately 3:30 Tuesday, when a mother and two children were in the crosswalk at Rolling Hills Drive and Puente Street, near Beechwood Elementary School. </p>
<p>Sgt. Goodrich said traffic investigators are trying to determine how the accident occurred that involved a <a href="http://www.nursingethicsnetwork.org/">90 year old driver</a>. The driver after hitting the mother and two children crashed the Ford Focus she was driving on Puente Street into a tree, north of Sandalwood Avenue.  According to Sgt. Goodrich, witnesses said that the driver was speeding down the street, while children were getting out at the elementary school. They said that when she was taken out of the wrecked vehicle that the 90 year old appeared to be groggy. </p>
<p>Traffic investigators do not know if a medical condition played a role in the woman striking the pedestrians and then crashing into a tree. The mother and children ages 6 and 9 were transported to the hospital with serious injuries, but are expected to survive, Sgt. Goodrich said. Sgt. Goodrich said the 90 year old driver was transported to the hospital and is listed in critical condition. The driver could be cited for not yielding to pedestrians in a crosswalk, if found at fault and if traffic investigators believe it is appropriate she could be referred to the Department of Motor Vehicles to be reevaluated to have a driver’s license. </p>

			<content:encoded><![CDATA[<p>Zoning, or the process of assigning types of construction to certain kinds of property in a given town or county may seem like it doesn&#8217;t mean much for <a href="http://www.livingsenior.com/">senior living</a>. A number of operators are finding out that these boards are having a real impact on where they can build, renovate or even construct additions.??</p>
<p>Take New York City, a town where the value of square feet is measured in the hundreds, if not thousands of dollars. Along the Upper West Side, Jewish Home Lifecare was trying to build an extensive skilled nursing facility, but that&#8217;s been held up by local residents.??The location is just about a mile away from the existing facility, but residents have voiced a number of concerns. They note that a local school is adjacent to the proposed construction site, and that the road could be blocked by the increased traffic that such a facility would represent over the existing parking lot, reports DNAInfo.??Even though the senior living advocates argued that the facility didn&#8217;t actually need approval, residents still pushed for, and got, a public hearing on the issue. </p>
<p>And that&#8217;s on a project that was already slated for approval.?? Elsewhere, a number of counties and towns don&#8217;t actually have zoning specifically for <a href="http://www.livingsenior.com/">senior living facilities</a> for independent living, assisted living or nursing home care. This can lead to problems because these are multi-resident units, which may not be allowed in residential areas, for example. Or on the other hand, a commercial zone that has a nearby hospital might not be available to developers.??Younger adults and even adult children of aging residents should be aware of these issues. The reason that facilities are generally clustered in certain areas is because of these zoning restrictions. </p>
<p>If you are aware of a project that could be a great fit for a loved one, there are a number of options that could speed approval.?? The first is to simply show up at a zoning board meeting where the developer plans to present. All too often, these are lightly attended affairs, and putting a human face to who will end up in one of these homes can help board members understand the value to a town or city.?? Another is to be on the lookout for issues on ballots that are related to zoning, ones that are either up for a vote in a town council or as part of an upcoming election. Being active can pay dividends in either case.?? The U.S. is facing a senior population that is set to double by 2050, and the laws don&#8217;t yet reflect that. But by acting locally, you may just find that you can help speed up the process in individual cases.</p>

<h2>Home Health Care Nurse Gang Raped While En Route to Patient&#8217;s Home</h2>
<p>An arrest has been made in the horrific <strong>gang rape of a Home Health Care Nurse</strong> who was en route to the home of a patient under her care when the abduction occurred.</p>
<p>Roughly a week after the assault, Brian Beasley, 21, surrendered himself to authorities sometime in the early evening Wednesday, February 2. Beasley was booked with aggravated rape, armed robbery and aggravated kidnapping.</p>
<p>Police have identified at least three other suspects, and are asking for the public&#8217;s help in locating Darren Holmen, 19, Jermaine Rumley, 21 and Glenn Elliott, 17.</p>
<p>On the evening of Thursday, January 26, a 53 year old female home health care nurse was abducted at gunpoint by two men, who took her to an obscure Mid-City location where she was repeatedly raped by at least four and possibly as many as six men. Five days after the assault occurred, the NOPD (New Orleans Police Department) had still not completed its initial police report, declining to issue a statement or provide further details due to the sensitivity of the still pending investigation.</p>
<p>According to friends of the victim, two men &#8211; both of whom were armed &#8211; approached the nurse as she made her way to the home of a patient for whom she was providing <a href="http://eganhealthcare.com/">home health care services</a>, and demanded that she accompany them to an obscure Mid-City location near the intersection of Erato and South Gayoso streets. The area was described in a report by the Times Picayune as &#8220;desolate&#8221;, and full of overgrown lots and abandoned homes.</p>
<p>The woman&#8217;s friends, who asked to remain anonymous, told the Times Picayune that the lady works as a home health care nurse, and was in the process of walking to the home of a patient for whom she is a provider of in-home care when the two men approached her. The victim&#8217;s car was parked in the vicinity of the patient&#8217;s home when the two armed assailants approached.</p>
<p>Other details assiciated with the crime such as from where the woman was abducted, and for how long she was held captive, have not been made available to the public. NOPD Spokeswoman Remi Braden issued a statement that the case was an active and sensitive investigation, and that the NOPD would have no further comment until further notice.</p>
<p>The spokeswoman added that since it is a sexual assault case, the department will not confirm details, since doing so could potentially &#8220;prove harmful to this criminal investigation as well as, and more importantly to, the victim herself.&#8221;</p>
<p>What has been reported is that the assault took place in a &#8220;rundown home&#8221; near the 1300 block of S. Gayoso Street. The home is part of a fourplex owned by the CEO of a state agency charged with redeveloping portions of the Central Business District and Mid-City into a medical corridor.</p>

			<content:encoded><![CDATA[<p>November 8, 2011 &#8211; According to reports by the <a href="http://www.ehlinelaw.com/">elder abuse attorneys</a> at Ehline Law Firm PC, a retirement living facility had to be evacuated after a fire broke out. According to authorities the Pledgerville Senior Citizens Villa is where a fire was reported at approximately 11:00 a.m. in Pacoima. </p>
<p>According to firefighters, the retirement living facility is located at 11060 Norris Avenue, where 50 firefighters responded. Firefighters stated that they were able to contain the blaze to one unite and took fire crews approximately 17 minutes to extinguish the fire.<br />
According to authorities there were some residents that were treated at the scene for minor injuries and one person was transported to the hospital for treatment of their injuries.  Authorities expect that residents of the retirement facility are expected to be able to return to their homes this afternoon. </p>

The victim of elder abuse in a nursing home setting has no one to tell, except their family, who will leave and then they will be at the mercy of their abuser. This is why it is up to families to be observant when visiting a loved one that resides in a nursing home or long term care facility. It is up to the nursing home to ensure that the senior citizen has a safe environment to live, which includes their employees actions. </p>

			<content:encoded><![CDATA[<p>Federal officials have confirmed that a Yale University student died after her hair was pulled into a piece of equipment in a chemistry lab machine shop last week. The University reported to the United States Labor Department&#8217;s Occupational Safety and Health Administration (OSHA) that Michele Dufault was operating a fast-spinning lathe when her hair became caught in the machine, causing her death. Dufault reportedly died from accidental asphyxia by neck compression.</p>
<p>OSHA is reviewing the matter and has opened an inspection that will look into factors surrounding the death and whether the lab complied with applicable safety standards. University President Richard Levin said that the school has also initiated a review of the safety policies and practices of the school&#8217;s <a href="http://www.nursingethicsnetwork.org/">laboratories</a>, machine shops and other facilitates where students have access to power equipment. He indicated that access to such facilities will be limited until review is completed and that monitors will be present in the facilities.</p>
<p>On its website, the Yale Chemistry department states that it maintains &#8220;a state-of-the-art Machine Shop&#8221; where students, faculty and staff can build or modify research instruments. According to the site, access to the shop is limited to persons that have completed a shop course. While a staff member is present in the lab during the daytime hours, many students use the shop at night. Other students working in the building found Ms. Dufault&#8217;s body and called the police. The lab was closed following the incident.</p>
<p>College campuses, like any other work site, must have the necessary policies and procedures in place to prevent serious injuries and death, and ensure the safety of students, staff and faculty. The current investigations will assess which safety standards apply and whether the university complied with  those standards.</p>
